Appraisal Rules for Li Buyun Jurisprudence Award

Chapter 1  General

Article 1 In order to promote legal research and encourage legal science exchange, Shanghai Institute of Finance and Law (hereinafter “the Institute”) established Li Buyun Jurisprudence Award.

Article 2  Candidates for the award persons include Chinese scholars who have outstanding contributions to Chinese law science and foreign scholars or institutes of outstanding contribution to the exchange on law science and education between China and foreign countries.

Article 3  Li Buyun Jurisprudence Award is issued annually, with one Chinese scholar and one foreign scholar or institute awarded each time.

Article 4 Award for Each winner shall be no less than RMB 800,000.

Chapter 2  Organization

Article 5  To guarantee scientific, objective and just appraisal work, Li Buyun Jurisprudence Award appraisal committee (hereinafter “Appraisal Committee”) was established.

              Appraisal Committee set up offices for daily works of the committee.

Article 6  The committee consists of 15 to 19 committee members. Term of office is five years. The committee members can be reappointed.The committee members are appointed by the Institute.

Article 7  The committee has one chairman committee and several vice chairmen. Such position can be reappointed.Chairman and Vice Chairmen shall be elected among the appraisal committees and appointed by the Institute.

Article 8 By the end of a committee’s office term or where a committee member leaves the position, such committee shall appoint candidate for the position. The candidate will become a new member of Appraisal Committee after a simple majority vote by the board of the Institute.

Article 9  Qualification for appraisal committees:

            a. Engaging in law study, familiar with the history and current situation in respect of relative research areas at home and abroad;

             b. Of sufficient academic level and accurate academic judgment;

            c. Of high academic morality, rigorous academic style and justice and equity;

             d. With a strong sense of social responsibility, active in public welfare.

Article 10 Main responsibilities for the appraisal committees:

             a. Confirm specific appraisal standards based on the appraisal conditions stated in this Rules;

             b. Deliberate on nominated award candidates and determine the final award winner;

             c. Deal with major problems arising in the appraisal work and disputes and complaints against the appraisal work;

             d. Conclude the appraisal work and make suggestions for revision in due time.

Chapter 3  Appraisal Procedure

Article 11  Candidates for the award shall be nominated by the appraisal committees and experts jointly. Nominating experts are recommended by appraisal committees. Each committee member can recommend 3 persons for the nominating experts.

Article 12  Each committee and nominating expert can nominate 1-2 candidates and submit the name and their contributions to the Appraisal Committee Office.

Article 13  The Appraisal Committee Office will conduct formal examination on the contributions of the nominated candidates.Results of the examinations will be submitted to the Appraisal Committee for review and vote.

Article 14  Meeting of the Appraisal Committee shall be invalid otherwise it is attended by more than 2/3 (two thirds) of the whole committee.

Article 15  Candidates will be determined by secret ballot of the committee.Each committee member can vote for and only for 1 domestic and 1 foreign candidate.The award winner shall be approved by more than half of the committee.

Article 16  The Institute will make decision for the issuance of the award in accordance with such vote results.

                Final appraisal results will be released by the Institute.

Article 17  None of the appraisal committees or relative staff shall be allowed for behaviors violating their positions as appraisal persons, including:

               a. divulge information associating with the appraisal work;

               b. extort or accept gifts and payments as bribes;

               c. where an immediate family member of a committee member attends the award, the Appraisal Committee shall be informed and such committee member should avoid relative appraisal work.

               d. Other behaviors that may harm the reputation of the Appraisal Committee.

Chapter 4  Supplementary Articles

Article 18  Li Buyun Jurisprudence Awardevision and explanation of this Rules

Article 19  This Rule shall come to effect from the date on which Li Buyun Appraisal Committee vote through.
